1. Definitions

• "Service" means the SiteRecord website, web application, voice calling system, SMS messaging, and all related features.
• "Account Holder" means a general contractor, project manager, or other construction professional who creates an account on SiteRecord.
• "End User" means a subcontractor or other individual who receives voice calls or SMS messages from SiteRecord on behalf of an Account Holder.
• "Report" means a daily construction report generated through the Service.

2. Account Registration

To use certain features of the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Add End Users to the platform without their knowledge or consent to receive calls and messages
• Provide false or misleading information in reports
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to transmit harmful, offensive, or illegal content

4. Voice Calls

The Service includes automated AI-powered voice calls to End Users for the purpose of collecting daily construction reports. By adding an End User to a project, the Account Holder represents that they have informed the End User that they will receive automated voice calls from SiteRecord and have obtained any required consent. All calls are recorded and transcribed for the purpose of generating reports. Call recordings are accessible to the Account Holder who manages the project.

5. SMS Messaging

The Service sends SMS messages to End Users for missed-call follow-ups and photo upload links. By using the Service, Account Holders consent to SMS communications related to their account. Account Holders represent that End Users have been informed they may receive SMS messages from SiteRecord.

Message frequency varies by project schedule, typically 1–2 messages per reporting day. Message and data rates may apply. End Users can opt out at any time by replying STOP to any message. Reply HELP for assistance. For support, email support@siterecord.com.

6. Photos and Uploaded Content

End Users may upload photos and other content to the Service via SMS or web upload links. By uploading content, you grant SiteRecord a non-exclusive, royalty-free license to store, display, and process the content solely for the purpose of providing the Service. You represent that you have the right to upload any content you submit and that it does not infringe the rights of any third party.

7. Intellectual Property

The Service, including its design, features, code, and documentation, is owned by SiteRecord LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent. Report data generated through the Service belongs to the Account Holder.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED REPORT DATA MAY CONTAIN INACCURACIES AND SHOULD BE REVIEWED BY THE ACCOUNT HOLDER BEFORE RELIANCE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITERECORD LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless SiteRecord LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon notice. You may terminate your account at any time by contacting us at support@siterecord.com. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
